$13.8 million verdict: Mesothelioma death
Represented the family of a decorated Navy Vietnam era combat veteran who developed mesothelioma from exposure to asbestos aboard a Navy vessel in the 1960s. After reaching settlements with all but one defendant, we worked with associated trial counsel to obtain a verdict against the remaining asbestos product manufacturer. We then settled the verdict for a confidential lower amount.
$22 million verdict: Mesothelioma death
Served as co-counsel at trial representing the family of a man who died of mesothelioma. After reaching pre-trial settlements with many defendants, we tried the case against just one asbestos product manufacturer. The judge remitted the verdict and we reached a confidential settlement.
Substantial settlement: Mesothelioma lawsuit against foreign asbestos cement pipe manufacturer
November 2006 – December 2007
Reached an unprecedented settlement with a foreign manufacturer of asbestos cement pipe in a lawsuit on behalf of a school guidance counselor whose mesothelioma was caused by his exposure to the asbestos pipe during a summer job while in college.
$5.1 million settlement: New Mexico truck crash wrongful death
May 2010 – October 2011
Negotiated a $5.1 million High-Low settlement in a truck collision wrongful death lawsuit in which we worked with co-counsel at trial to obtain a $4.6 million verdict—the highest verdict on record in Gallup, New Mexico. The defendant paid the total amount.

Proven Experience: Transnational Mass Tort Litigation
Scott Hendler serves as lead counsel in pending transnational toxic injury litigation on behalf of hundreds of Latin American banana plantation workers injured by exposure to DBCP, a now banned pesticide that causes sterility. We have won precedent setting victories in the United States Supreme Court, the Delaware Supreme Court and the Hawaii Supreme Court. The U.S. Supreme Court appeal successfully challenged application of the Foreign Sovereign Immunities Act and resolved a conflict between the federal circuits to make new law.
In 1992, firm founder Scott Hendler worked as a member of the litigation team responsible for the successful administration of a $20 million settlement on behalf of 1000 Costa Rican banana plantation workers who suffered toxic-related injuries.
